Uh, no. Even if legally yes, no. If you want to set people up for something, you can choose anything you want. A black person wanting to frame a white person for something might choose racism as a potential cause, but that doesn't mean either person is a racist. It's just a handy, and generally believable excuse. That doesn't mean it ISN'T a hate crime, but you shouldn't stoop to saying every crime against a black person by a white person is a hate crime, etc. Faking a crime is faking a crime, and that's it. There might be other motivations, and you could judge the person to be guilty of a hate crime in this instance, but not as an absolute.
